Is it illegal in the state of Texas to offer cash back through a credit card/debit card machine in a bar>?

Being sold an ATM machine for placement in a bar in Tarrant County, Texas. Seller is telling me that there is legislation against bars or restaurants selling alcoholic beverages being allowed to offer credit card/ debit card customers cash back. Stating that as the reason I must have ATM instead of programming credit card/ debit card machine to allow cash back.

Sorry I don’t know. However, You could check with your state legislator or the alcohol state regulatory commissions/board.
Remember the seller want you to buy an ATM. They could try any thing so you will bye it.
The best place to check. Is where you get your alcohol licenses from.
There is nothing wrong with a bar using a point of sale terminal that take both credit and debit cards. The debit part can allow cash back. The Credit part will not at this time.
